Regulations Regarding Fencing in Farmington

Where can I place my fence on the property?

In Farmington, all residential fencing must be installed at least two feet behind the property line to help avoid potential neighborly disputes and to not encroach on public easements. Fences must also be constructed so as to not obstruct intersections. This means if your fence will block the view of a driver, it must not be taller than four feet in height. 

Do I need to notify my neighbors? If so, when?

It’s highly encouraged to show common courtesy by informing your neighbor of the new fence installation to avoid any disputes. This will greatly help if you need to be on your neighbor’s property during the process. If you’re going to build a fence on the property line, you will need to speak with your neighbor about it as they also own part of the property line. Whether a fence already exists on the property line, or one is going to be built there, we recommend that you discuss maintenance with your neighbor and determine who will be responsible for what. This can make future upkeep much easier and clear cut. 

Do I need a fence permit?

Every fence in Farmington, MN, requires a permit. The only exception is anything under three feet tall, commonly referred to as a garden fence. You can easily access the paperwork online, print it out, and mail it in to complete your application. There is a permit fee of $30. 

Who calls the utilities when installing a fence?

What are the height restrictions on fences in Farmington, MN?

For the average permit, you may build a residential fence that is up to 6 feet in height. You can also apply for a variance up to an eight-foot-tall fence for industrial or commercial districts. Be aware that any fence within five feet of a neighboring driveway or 30 feet from an intersection cannot exceed four feet in height to ensure proper visual clearance.

Additionally, if you have a pool, you must have an enclosed fence up to at least four inches with a locked gate to prevent unsupervised children from entering it.

Can I build my fence on an easement?

It is illegal to block access to any easement because it must remain available for city workers and pedestrians. Work with your fence installation company to determine the best course of action to avoid possible fines or damage.

Are there any design or material restrictions?

All agricultural materials, including barbed wire, poultry fencing, “T-posts,” or electric fences are not allowed in residential areas. Other restricted materials include plywood, canvas, plastic, and metal sheeting.
